Licensing Exclusions
1. Excluded uses
Use in or for the following is excluded:
- Advertising for real weapons, ammunition or gambling for money, including sports betting, also in the form of sponsorship
- Propaganda for extremist ideologies or for extremist, terrorist or banned organisations
- Content that calls for unlawful violence, endorses real violent crimes or incites hatred against persons or groups
- Content that violates the personality rights of real people, for example through defamation, exposure, harassment or extortion, including intimate images and deepfakes made without the consent of those depicted
- Content that sexualises minors or trivialises or endorses sexual abuse of minors, including fictional, drawn or AI-generated content
- Content that primarily serves sexual arousal
- Own or third-party AI systems, with the music as training, test or source material, in whole, in part or as part of a production, including text and data mining
- Other content or purposes that are unlawful under Austrian law
2. Uses requiring separate approval
Use in or for the following is permitted only with separate written approval from Spheric Pulsar Production for a specific campaign or production:
- Political advertising, for example for parties, politicians and political institutions or about elections and referendums
- Advertising and public relations for armed forces or defence companies, such as image and recruitment films
3. Interpretation
What counts is the purpose of the use, not the subject of the production. Fictional productions such as films, series and games, as well as historical, documentary, artistic, satirical and critical productions, may depict and address violence, crime, war, weapons, extremism, gambling and sexuality, as long as they do not themselves fall under one of the points above. Nudity and nude depictions, for example in art, film or photography, do not in themselves primarily serve sexual arousal. Whether a use is permitted can be clarified in writing in advance. Approval may be subject to conditions. Exclusions take precedence over any approval. Spheric Pulsar Production reserves the right to decline a licence without giving reasons. The licence agreement is binding.
